Terms & Conditions of Sale
By accepting a quote, submitting payment, or purchasing equipment through Compressor Market, the customer agrees to the following Terms and Conditions of Sale.
Payment Terms
Unless otherwise agreed to in writing, full payment must be received and cleared before any compressor or related equipment will be released, shipped, picked up, or delivered to the customer.
Compressor Market reserves the right to withhold equipment until all amounts due, including applicable taxes, freight, storage, handling, or other agreed-upon charges, have been paid in full.
Equipment Sold "As Is"
Unless expressly stated otherwise in writing, all compressors and related equipment are sold "AS IS, WHERE IS," with all faults and without warranties by Compressor Market.
The customer is responsible for reviewing the equipment specifications, condition, configuration, capacity, compatibility, and suitability for its intended application before completing the purchase.
Photos, specifications, operating hours, descriptions, and other equipment information are provided for informational purposes and may be based on information supplied by manufacturers, owners, dealers, or other third parties.
OEM Warranty Only
Compressor Market does not provide or extend any independent warranty on equipment sold.
If the equipment includes a valid Original Equipment Manufacturer ("OEM") warranty, the customer may be entitled to the remaining warranty coverage subject solely to the OEM's applicable terms, conditions, exclusions, and warranty procedures.
Any warranty claim must be made directly under the applicable OEM warranty. Compressor Market does not guarantee that an OEM will approve or honor a warranty claim.
Except for any applicable OEM warranty, the equipment is sold without express or implied warranties, including, to the extent permitted by applicable law, warranties of merchantability or fitness for a particular purpose.
Equipment Specifications & Customer Responsibility
The customer is responsible for confirming that the compressor selected meets its operational requirements before purchase.
This includes, where applicable, verifying pressure, flow, horsepower, voltage, frequency, fuel type, environmental requirements, dimensions, connections, accessories, controls, emissions requirements, certifications, and compatibility with the customer's application.
Compressor Market is not responsible for equipment purchased based on incorrect or incomplete information provided by the customer.
Quotes, Pricing & Availability
All quotes are subject to equipment availability and the expiration date stated on the quote.
Equipment is not considered sold or reserved until the payment requirements specified in the quote have been satisfied and Compressor Market has confirmed the order.
Pricing may exclude freight, taxes, duties, permits, installation, commissioning, insurance, or other charges unless specifically included in the quote.
Shipping, Delivery & Risk of Loss
Shipping and delivery arrangements will vary depending on the equipment, supplier, customer location, and terms of the transaction.
Estimated shipping and delivery dates are provided in good faith but are not guaranteed. Compressor Market is not responsible for delays caused by freight carriers, manufacturers, suppliers, weather, customs, governmental actions, or other circumstances outside its reasonable control.
Responsibility for freight costs, insurance, title, and risk of loss will be determined by the terms stated in the applicable quote, invoice, or purchase agreement.
Inspection & Acceptance
Customers are encouraged to inspect equipment or arrange for an independent third-party inspection before purchase when appropriate.
By approving the purchase, the customer acknowledges that it has reviewed the available information and accepts the equipment subject to the terms of the transaction.
Any visible shipping damage should be documented immediately upon delivery and reported to the carrier and Compressor Market promptly.
Cancellations, Returns & Refunds
Unless otherwise agreed to in writing, all equipment sales are final.
Orders may not be cancelled after payment or confirmation without written approval from Compressor Market. Any approved cancellation or return may be subject to restocking, transportation, inspection, administrative, or other applicable charges.
Special-order, sourced-to-request, customized, or specifically procured equipment may be non-cancellable and non-refundable.
Storage Charges
If equipment is ready for pickup or shipment and the customer fails to take delivery within the agreed timeframe, Compressor Market reserves the right to charge reasonable storage, handling, insurance, or related costs.
Equipment will not be released until all outstanding charges have been paid.
Installation, Operation & Maintenance
The customer is responsible for the proper transportation, installation, commissioning, operation, inspection, maintenance, and use of the equipment.
Installation and operation should be performed by qualified personnel and in accordance with applicable OEM instructions, safety requirements, codes, regulations, and industry standards.
Compressor Market is not responsible for damage, injury, downtime, or losses resulting from improper transportation, installation, operation, maintenance, modification, misuse, or application of the equipment.
Limitation of Liability
To the maximum extent permitted by applicable law, Compressor Market will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost production, loss of use, business interruption, or downtime arising from the purchase, delivery, condition, installation, operation, or use of equipment.
To the extent permitted by applicable law, Compressor Market's total liability relating to any transaction will not exceed the amount actually paid to Compressor Market for the specific equipment giving rise to the claim.
Taxes, Duties & Regulatory Requirements
The customer is responsible for applicable sales, use, import, export, customs, duties, tariffs, permits, registrations, and other governmental charges unless specifically stated otherwise in writing.
The customer is also responsible for determining whether the equipment complies with applicable local, state, federal, or international regulations for its intended location and use.
Third-Party Equipment & Information
Compressor Market may source equipment through manufacturers, distributors, dealers, equipment owners, and other third parties.
While we make reasonable efforts to provide accurate information, Compressor Market does not guarantee the accuracy or completeness of information supplied by third parties. Customers should independently verify any specifications or information material to their purchasing decision.
Force Majeure
Compressor Market will not be responsible for delays or failure to perform resulting from circumstances beyond its reasonable control, including natural disasters, severe weather, transportation interruptions, labor disputes, governmental actions, supply-chain disruptions, manufacturer delays, war, civil unrest, or other similar events.
Acceptance of Terms
By accepting a quote, issuing a purchase order, submitting payment, or otherwise authorizing a purchase, the customer acknowledges that they have reviewed and accepted these Terms and Conditions along with any additional terms contained in the applicable quote, invoice, or purchase agreement.
If there is a conflict between these Terms and Conditions and specific written terms contained in an executed purchase agreement, the executed purchase agreement will control.
